Trump signs executive memorandum directing trade investigation against China

On the afternoon of the 14th local time, U.S. President Trump signed an administrative memorandum at the White House, instructing U.S. Trade Representative Lighthizer to launch an investigation into the so-called “China’s unfair trade practices” to ensure that U.S. intellectual property rights and technology are protected. This means that Lighthizer may invoke Section 301 of the U.S. Trade Act of 1974 to initiate a “301 investigation” against China. This provision authorizes the U.S. Trade Representative to initiate investigations into unreasonable or unfair trade practices of other countries, and to recommend to the U.S. President the imposition of unilateral sanctions such as additional tariffs after the investigation is completed.

“Section 301” was widely used in the United States in the 1970s and 1980s, but since the establishment of the World Trade Organization in 1995, the United States has generally resorted to disputes through the Geneva-based agency rather than unilaterally action, so “Section 301” is not widely used.

In response to related issues, Chinese Foreign Ministry spokesperson Hua Chunying pointed out on the 14th that relevant trade measures should abide by WTO rules and that a trade war has no future and will only lead to a lose-lose situation.
