India made its first affirmative final ruling on anti-dumping review of Chinese polyester high-elastic yarn
On April 6, 2023, the Ministry of Commerce and Industry of India issued an announcement stating that it would conduct the first anti-dumping sunset review of polyester high elastic yarn (HighTenacity Polyester Yarn) originating in or imported from China. The final ruling is affirmative, and it is recommended to continue to impose anti-dumping duties on the Chinese products involved for a period of five years, with the tax amount ranging from US$0 to US$528/metric ton (see the attached table for tax details). The anti-dumping measures in this case do not apply to the following products: yarns of less than 1,000 denier, yarns of more than 6,000 denier, twisted yarns, colored yarns, adhesive active yarns of more than 1,000 denier and yarns with high modulus and low shrinkage (HMLS) properties. On September 30, 2022, the Ministry of Commerce and Industry of India issued an announcement stating that in response to an application submitted by the Indian domestic enterprise Reliance Industries Limited, it would launch the first anti-dumping sunset review investigation into polyester high-strength yarn originating in or imported from China. On March 31, 2023, the Indian Ministry of Commerce and Industry made a positive final ruling on China’s anti-circumvention investigation of polyester high-elastic yarn, ruling that the product involved in the case in China had changed its description, name or ingredients to circumvent the current anti-dumping duties.
